I work in New York. My company has refused to pay me the extra hour I worked when they turned the clock back. The reason they give is "we paid you for the hours the timeclock says". Is this legal? By the way, they have paid this for the last three years I worked there and also have only paid seven hours when the clock moves the other way. We just got a new pay master.

    • If you are an hourly employee, they must pay you for your work hours.

      No questions asked. If you work an eight hour day and your contracted as an hourly waged employee then you are entitled to that hour of work you performed whether or not an hour 'magically' disappeared that day.

      Contact the DOL.

    • I agree. You must be paid for all the hours you worked, including the "lost hour" due to the time change. Your new paymaster doesn't appear to know what he's doing.
